Probate
Probate is a legal process that happens after someone passes away and is used to prove that the will is valid and that the person named in the will as the executor is able to carry out the instructions in the will. It’s kind of like a formality to make sure that everything is in order and that the wishes in the will can be carried out.
Think of it like getting a key to a locked box, where the box has all the instructions for what to do with someone’s things and money after they pass away. The probate process is what unlocks that box and allows the executor to access the instructions and carry out the wishes of the deceased.
Probate is important because it gives the executor the legal authority to access bank accounts, pay debts and distribute assets to the beneficiaries named in the will. Without probate, it could be difficult or impossible for the executor to access the deceased’s assets, and to carry out the instructions in the will.
It’s also important to note that if someone dies without a will, the probate process is still needed to administer the estate. In this case, the court will appoint an administrator who will be responsible for distributing the assets according to the laws of intestacy.
